Terms & Conditions
I hereby claim responsibility for myself, and waive and release any and all rights to claim for damages, losses, costs, expenses, injuries, and liabilities from or in connection with my participation in the United Airlines NYC Half Marathon.
1. I am an adult 18-years or older and assume all responsibility for any and all damages to or theft of personal property or any bodily injury (including death) that may occur to me or that I may cause to others, in each case arising or resulting from or incident to my training and participation in the United Airlines NYC Half Marathon.
2. I understand that participating in and training for the United Airlines NYC Half Marathon are hazardous activities, and I attest and certify that I am physically capable and properly trained to participate in this event.
3. I have read and agree to abide by all the rules and procedures of the United Airlines NYC Half Marathon. I agree to register for the United Airlines NYC Half Marathon directly based on the requirements and standards set by New York Road Runners, and I agree to pay any fees set by the race.
4. I agree that my participation in and fundraising for the United Airlines NYC Half Marathon are non-transferable. I agree that if the race cannot be held for any unforeseen circumstance, any funds I have raised for the Lustgarten Foundation will not be refunded.
5. I grant full permission to the Lustgarten Foundation to use my name, photos, video, voice, and/or likeness from my participation in the United Airlines NYC Half Marathon in any medium, including telecasts, social media, promotions, publications, photographs, videos or other accounts of this event at any point.
6. I understand that any interaction with the general public poses an elevated risk of being exposed to COVID-19 and the Lustgarten Foundation cannot guarantee that I will not be exposed to COVID-19 while training for or participating in the United Airlines NYC Half Marathon. By attending this or any in-person United Airlines NYC Half Marathon events, I voluntarily assume all risks related to exposure to COVID-19. The Lustgarten Foundation is not responsible for the health and safety of this event, and I understand I should follow the laws and safety policies of my local and state government as well as the Centers for Disease Control.
7. I agree to provide a valid credit card number in my name and valid through June 2025 with this Waiver, Release and Fundraising Agreement. I agree to collect the fundraising minimum of $1,400 for the Lustgarten Foundation through personal donations, sponsorships and other strategies by the end of the day of the United Airlines NYC Half Marathon. If I have not reached the minimum commitment by such date, I will be personally responsible for, and my credit card provided with this Waiver, Release and Fundraising Agreement will be charged for, the balance of my fundraising commitment.
8. I hereby for myself, my heirs, and personal representatives assume any and all risks that might be associated with the United Airlines NYC Half Marathon. I further waive, release, discharge, and covenant not to sue the Lustgarten Foundation or its officers, directors, employees, sponsors, organizers, volunteers, agents, related entities, or other representatives, or its successors and assigns, for any and all injuries and damages or rights of action of any kind, present or future, whether the same be known or unknown, anticipated or unanticipated, foreseen or unforeseen, arising or resulting from, incident to or as a consequence of my participation in the United Airlines NYC Half Marathon.
WITHOUT LIMITING THE FOREGOING IN ANY WAY, I INTEND THIS TO BE A GENERAL WAIVER OF ANY AND ALL CLAIMS WHICH ARE IN ANY WAY RELATED TO MY PARTICIPATION IN THIS EVENT. I attest that I have had sufficient opportunity to read this entire agreement and that I have read and understood it and agree to abide by all the terms and conditions detailed.
